Use of and any orders you place with CakeCandyCo via this website is subject to you agreeing to our terms and conditions. The completion of an order form and payment for the products shall be deemed conclusive evidence that you agree to be bound by these Terms & Conditions. These terms and conditions do not affect your statutory rights.

General

We reserve the right to make changes to these terms and conditions in the future. Any changes will be posted here and will take effect immediately. The material and information contained in this online shop is not aimed at, or meant to be viewed by, persons other than those in the United Kingdom. Any person who chooses to access this online shop from other locations is responsible for compliance with applicable local laws. CakeCandyCo website, its contents and any contracts formed as a result of its use shall be governed by and construed in accordance with Scottish law and shall be subject to the exclusive jurisdiction of the Scottish courts.

Placing an Order and Dispatch

When you place an order through the CakeCandyCo we will send an e-mail to confirm that we have received the order. Orders are not deemed concluded until payment is received in full for all products and any related delivery charges. Orders placed through this online shop represent an offer to purchase a product. The offer is accepted (for each product) when we send you an e-mail to confirm that the order has been dispatched. An order cannot be cancelled once processed. We reserve the right to reject any order for any reason which may include but is not limited to delivery to PO Boxes, caravan sites, hotels or other destinations we consider high risk.

All orders are subject to stock availability. If we have a suitable replacement that will be sent instead. If we are unable to supply any products that you have ordered we will inform you as soon as possible. In the event that an out-of-stock product is part of an order or we are unable to complete the order for any other reason and we cannot contact you within 3 days, we will cancel your entire order and refund you in full.

Orders placed after 2:00 pm Monday to Friday and at any time of day on Saturday and Sunday will be processed on the following working day.

We do not ship on Saturdays, Sundays or UK Bank, Public and Local Holidays. Additional items cannot be added to an existing order. Should you wish to purchase additional items you will need to place a new order for those additional items.

Postage & Packaging - RATES AS STATED

Our postage and packaging rates may vary from time to time as determined by price increases to ourselves. We use Royal Mail Tracked parcel post as standard unless otherwise selected and we will not accept liability for any loss or damage arising from a late delivery or for loss of damage arising after delivery has taken place and you agree that late delivery does not constitute a failure of our agreement, and does not entitle you to cancellation of an order. We are unable to give a guaranteed time of delivery. CakeCandyCo shall not be responsible for delay or failure to deliver products due to incorrect address or name information supplied.

CakeCandyCo shall not be liable for delay or failure to deliver products promptly if such failure arises due to force majeure or by reason of any delays occasioned by Royal Mail actions, government lockdowns, viruses, lockdowns, strikes, riots, lockouts or other labour trouble, war, fire, accident, mechanical failure, power outages, grid hacks, computer hacks, phone line hacks, cloud hacks, non-availability to CakeCandyCo of manufactured stock, parts, or materials; delay or failure of delivery of the products to CakeCandyCo by manufacturers suppliers or other persons; government action of any country, USSF legislation or regulation of any kind; Act of God, or any circumstances whatsoever outside our reasonable control.

If your order has arrived at your local Royal Mail delivery office but not been received by you it is your responsibility to contact them direct and arrange delivery.

ROYAL MAIL and COVID-19

Due to resourcing issues and associated self-isolation at some of their Delivery Offices, they advise that deliveries in some postcode areas will likely experience disruption. They apologise for any inconvenience this may cause and thank you for your understanding. Please be assured they’re working hard to deliver as comprehensive a service as possible and return to normal service as soon as they can safely do so.

Please note: To collect items from their Customer Service Point, you will need a valid 'Something for you' card or electronic notification advising they're holding an item for you. Please check royalmail.com/services-near-you for opening times, as these may be subject to change.

Pricing and Descriptions

All prices are inclusive of VAT at the prevailing UK rate where applicable. We take care to ensure all our products are priced accurately and photos and descriptions representative. In an instance where a product's correct price is higher than the price stated on our site, we will advise you on the error and give you the option to cancel the order. We are under no obligation to provide the product to you at the incorrect (lower) price. All prices are subject to change without prior notice. We take care to ensure images, descriptions measurements and any other details associated with our products provides a fair and accurate description. All our images are our photo images and you accept that minor variations can occur through the natural production process between the photo image and the item you receive (i.e. shades of colour). All measurements are approximate.

Promotions

From time to time we will offer free sprinkles with the option to select yes or no at check out however this option does not apply to ApplePay and GooglePay purchases.

Food Safety

All goods are stored and handled in a professional, hygienic environment at all times. CakeCandyCo meets and strives to exceed all Local Authority Environmental Health standards, EU Regulations and UK legislation covering the handling and labelling of edible products. Once any edible product leaves CakeCandyCo premises, we cannot control conditions which could affect hygiene, safety or quality and, therefore, CakeCandyCo will not accept the return of any edible item unless it was supplied incorrectly or is faulty. Put simply: when a customer purchases any edible product from CakeCandyCo, they can be assured it is brand new and has never previously left CakeCandyCo premises.

Please note candy shapes and sugar pearls can be hard though may soften once in contact with moisture such as runny icing or buttercream. We recommend caution when giving to tiny tots and the elderly.

Returns and Refunds

These decorations are food items and cannot be returned as they cannot be resold.

Please check your order upon receipt. If your order has been damaged in the post we will need photographic evidence before taking action in the form of a pro rata refund for the proportion of the product damaged including P&P. Sugar paste products are very fragile and refunds will be at our discretion. Please note, sugar pearls may come loose in the post but are easily fixed with a tiny dab of water and we will not issue refunds should this occur. If an item has been snapped in half upon removing from the packaging it can easily be repaired using a dab of warm water or icing.

In the unlikely event we have supplied an incorrect or partially incorrect order please contact us so we can either send a replacement or issue a refund for the incorrect item.

SALE items are sold as seen and cannot be returned or refunded.

Our products cannot be exchanged.

If an order or any part of has been made specifically to your requirement and request such as colour, name, age or other we cannot issue a refund.

Refunds can only be issued by the payment processor you paid with. Refunds will be processed within 28 days.

Should you declare there is a shortfall in your order we will need a photo of the whole box your order was delivered in plus the contents which we will then check with our records and parcel weight.

Copyright

The copyright in any photo, design, presentation, packaging and/or literature in connection with the products shall remain the property of CakeCandyCo or the owner of that copyright and no right or licence (except as to the use for which the products are supplied) shall be granted hereby whether express or implied.

Your Photographs

Should you share your creative projects with us by way of photographic image we will take that as permission that we can use it on our website.

COVID-19 Coronavirus

As of March 24, 2020 the advice from the Government is clear - "Online retail is still open and encouraged". We can reassure you that we are adhering to the Government's instructions to keep our staff and premises safe however this will be with reduced shipping days till further notice to reduce contact with Royal Mail staff. There will be no signed for postal services and no estimated dates of delivery due to Royal Mail staff shortages which vary from area to area although they are doing their utmost to deliver within a reasonable timescale and we are not experiencing many problems.

IMPORTANT - To this end please order in plenty of time for your occasion. We will not be held responsible for orders not meeting an expected date of delivery. Through this COVID-19 period we are only using Tracked shipping.
